Clemenvilla’s Rental Terms and Conditions
For the purpose of this agreement:
- The villa, located in Adsubia Alicante Spain, and called Clemenvilla, is hereinafter referred to as the “PROPERTY”. And-
- Mathieu R. Biron residing in Bangkok Thailand is hereinafter referred to as the “LESSOR”. And-
- Any party confirming a booking for the PROPERTY, directly through the LESSOR’s website (www.clemenvilla.com) or through any of its appointed Vacation Rentals Websites is hereinafter referred to as the “LESSEE”
- The LESSOR is the legal owner or has the right to occupy the PROPERTY.
- Whereas: the LESSOR desires to let, and the LESSEE desires to rent and occupy the PROPERTY as per the following conditions:
BOOKINGS
There are two ways in which a booking can be made by the LESSEE. Either the LESSEE can:
- Book the PROPERTY directly on the LESSOR’s website (www.clemenvilla.com) by using the LESSOR’s booking platform. On receipt of the completed booking request, the LESSOR will process the reservation and send the LESSEE a quote and request for deposit by e-mail within 24 hours. Thereafter, the lessor will reserve the requested dates for a maximum period of 72 hours pending the payment of deposit. A copy of ID card or passport of the person responsible of the booking is required upon confirmation of booking.
- Book the PROPERTY through any of its appointed Vacation Rentals Websites (“Vacation Rental Websites”) such as VRBO, Airbnb and OwnerDirect by using their booking and payment platforms. Any booking request made through Vacation Rentals Websites is subject to a service fee.
RATES & FEES
Rates
- Rental rates may vary depending on various factors and can be changed at any time prior to booking confirmation.
- Rental rates per night do not include cleaning fee and refundable damage deposit.
- All rental rates are quoted in Euros or equivalent in other currencies at the time of confirmation.
- Wireless internet connection is free of charge for all guests.
- Fees applicable to any extra services required are not included and only made available upon request.
Payments
- To confirm the booking, a 30% deposit of the total rental amount is required and must be paid to the LESSOR only by bank transfer to the provided bank account within 72 hours from the date/time of the request for deposit. Once the deposit is paid the LESSOR will confirm the booking by e-mail within 24 hours.
- Balance payment of 70% of the total rental amount is due 30 days prior to the arrival date and must be paid to the provided bank account or PayPal’s account by the due date shown on the Quote.
- Any booking request made less than 30 days prior to arrival date is required to pay in full amount. The payment must be paid to the provided bank account within 3 days by the due date shown on the Quote.
The LESSEE shall be required to pay any other fees (if any) as set out in the Quote as part of the payment.
The LESSEE should carefully check the details of the Quote before making any payment regarding the Booking, as well as the confirmation email and inform the LESSOR immediately of any errors or omissions.
The LESSEE acknowledges and agrees that the Payments conditions in this Agreement only apply when the LESSEE makes a booking directly on the LESSOR’s website. If the LESSEE makes a booking on Vacation Rental Websites, the conditions will depend upon the requirement of each website.
Cancellations
If the LESSEE needs to cancel the booking the LESSEE must notify the LESSOR in writing as soon as possible. A cancellation will not take effect until we receive confirmation from the LESSEE. Refunds will be permitted for bookings cancelled within the following time periods, prior to arrival:
- Bookings canceled at least 60 days before the start of the rental period will receive a 100% refund of the money paid.
- Bookings canceled at least 30 days before the start of the rental period will receive a 50% refund of the money paid.
- No refund for cancellation less than 30 days before the start of the rental period.
However, the LESSOR reserves the right to cancel the booking in the following circumstances:
- Any balance required from the LESSEE is not paid in accordance with the timeframes set out in the Quote; or
- The LESSEE does not arrive at the PROPERTY within 24 hours of the arrival time without notifying the LESSOR,
Then the LESSOR shall be entitled to treat such booking as being cancelled by the LESSEE and the LESSOR shall be under no obligation to refund the LESSEE for the amount already paid to the LESSOR. The LESSEE acknowledges and agrees that the Cancellations conditions in this Agreement only apply when the LESSEE makes a booking directly on the LESSOR’s website. If the LESSEE makes a booking on Vacation Rental Websites, the conditions will depend upon the requirement of each website.
OCCUPANCY
Rental Period
All bookings require 3-night minimum stay except for June-October, Christmas and New Year where minimum stay is 7 nights. Rental period may vary depending on various factors and can be changed at any time without prior notice.
Occupancy
- The number of guests (adults and children) staying at the PROPERTY shall not exceed the maximum number of sleeping places as stated in property specification (10 people), unless specifically authorized in writing and additional fee will apply. Exception of this terms are made only for infants less than 2 years old; if sleeping in a baby crib and not occupying one of the PROPERTY’s beds, they are NOT included in the PROPERTY’s total headcount.
- The LESSEE cannot allow more people to stay in the PROPERTY than expressly authorized, nor can the LESSEE significantly change the makeup of the party during your stay in the PROPERTY.
Check-in and Check-out
The PROPERTY is available after 2:00PM (local time) on the day of arrival and must be vacated by 12:00PM (local time) on the day of departure. By prior arrangement with the LESSOR, earlier arrival and later departure times may be possible (subject to other bookings in place).
Entry to the PROPERTY
The LESSEE permits the LESSOR or any representative of the LESSOR access to the PROPERTY at any reasonable time during the stay period for the purpose of essential repairs, in an emergency or to ensure that the terms and conditions of this Agreement have been followed accurately by the LESSEE. The LESSOR will make every effort to schedule such brief showings at a time convenient to the LESSEE, to respect the privacy, and not interrupt the stay. The schedule for essential repairs which including but not limited to pool and garden maintenance during summer is also depending on the availability of the maintenance staff.
Use of Utilities
- Normal use of gas, water, telephone, and electricity is included in the rental price. The LESSEE will be subject to the full costs of any additional charges if utility and/or telephone bills for the period of the stay are in excess of 10% above normal usage.
Miscellaneous
- The LESSEE may not transfer your Booking or any rights and responsibilities under this Agreement to any other person, without our prior written consent.
- The LESSOR will not be in breach of this Agreement, or otherwise liable for any failure or delay in performance, arising from any circumstances beyond reasonable control including, without limitation, flood, fire, explosion or accident.
- This agreement shall be governed by the laws of Spain in all matters, including any not specifically mentioned herein.
Pets
- Pets are not allowed.
LIABILITIES
Loss and/or damage
- The LESSEE is responsible for leaving the PROPERTY and its contents in a reasonable and former condition.
- THE LESSEE is not permitted to move and/or make alterations of any furniture or equipment without prior to the LESSOR’s consent. Any damage resulting from the moving and/or alteration of furniture will be charged to the LESSEE. In the event of such permission being granted, it is the LESSEE’s responsibility to return the same to its original location before the
departure at his own expense. Under no circumstances should any furniture or other items, made for use inside the PROPERTY, be moved outside. - The LESSEE shall deposit with the LESSOR a damage deposit in the amount of 950 Euros or equivalent in other currencies at the time of confirmation. This deposit is required to cover the cost of any damages or breakages, or missing items caused during the stay (Herein referred to as the “DEPOSIT”). This DEPOSIT will not bear any interest and will be held by the LESSOR throughout the rental period as security for any damage or loss the LESSOR may suffer during breach, non-performance or non-observance by the LESSEE as stated herein and shall not be used to pay any rent.
- For any booking through the LESSOR’s website (www.clemenvilla.com), the DEPOSIT is payable via bank transfer together with rental payment and will be returned within 7 days after the departure date once the PROPERTY has been checked and no breakage or damage or missing item. Any damage or breakage costing in excess of the damage deposit amount will be fully reimbursed by the LESSEE at departure or within 7 days of departure. If the LESSEE makes a booking on Vacation Rental Websites, the reimbursed term will depend upon the conditions of each website.
- Loss of the PROPERTY’s keys and gate remote controls will be charged at actual replacement cost.
The LESSEE AGREES AS FOLLOWS:
- To use the PROPERTY for dwelling purposes only. The LESSEE is not permitted to use the PROPERTY for commercial, illegal or immoral purposes. If the LESSOR considers the PROPERTY is being misused, the LESSEE may be required to vacate the PROPERTY.
- To keep and leave the PROPERTY and furnishings, including items such as kitchen equipment, crockery and glasses clean and in good condition.
- To not cause any damage to the walls, doors, windows or any other parts of the PROPERTY.
- To notify the LESSOR or his representative of any defect or damage to the PROPERTY within 3 days of such occurrence.
- To take all necessary steps to safeguard the PROPERTY and all its amenities while staying at the PROPERTY.
- To keep all doors and windows firmly closed and switch on the alarm system whenever the PROPERTY is unoccupied.
- To not use or permit to be brought into the PROPERTY any illegal substances, inflammable fluids or other explosives or articles deemed hazardous to life, limb or the PROPERTY.
- If any guest is found using illegal drugs, the LESSEE will be required to vacate the PROPERTY immediately, will not be entitled to any refund and will be fully responsible for any related consequences, whatever their nature.
- Although a small party is allowed, the LESSEE agrees to always maintain a reasonable behavior and avoid any disturbance, whatever their nature, to neighbors and outside parties. All arrangements are subject to consent and mutual agreement between the LESSOR and the LESSEE.
- All activities undertaken at the PROPERTY during your stay are at your own exclusive risk and insurance coverage. The LESSOR will not be responsible for any damage or accident incurring during your stay at the PROPERTY, whatever their cause, nature or consequences.
- The use of the swimming pool is at your own risk. The LESSEE is specifically advised not to allow unsupervised children near the pool. No diving is allowed. No glass of any kind is allowed in the pool.
- Although smoking is allowed in outside areas, smokers are asked to use ashtrays systematically, to extinguish any smoking item cautiously and not throw any of them on the floor.
- For privacy reasons, using drones in the area is strictly prohibited.
- The number of single or double bed arrangements must be disclosed at least 7 days prior to arrival date.
- The LESSEE agrees to remove any of his personal belonging or asset from the leased facility, on the date of the lease termination. Should any such belonging, or asset remain on the property after the LESSEE’s stay, the LESSOR has the right to keep it and to charge the LESSOR with any costs involved in the removal of such belonging or asset from the PROPERTY.
- In the event the LESSEE does not vacate the PROPERTY by the agreed booking dates, the LESSSEE agrees that the LESSOR shall have the following rights without any protest, obstruction, claim, or legal recourse whatsoever by the LESSEE against the LESSOR:
The LESSOR or its representative(s) is entitled to promptly repossess the PROPERTY by any possible mean (including but not limited to breaking doors, windows, repossessing keys), to immediately stop any service or utility related to property and to claim the LESSEE for all consequent costs, losses and damages until the LESSEE vacates the PROPERTY as per the terms and conditions stated in this document.
Limitation of liability
- The LESSOR does not accept any liability whatsoever, for any possible lost or stolen personal property or asset belonging to the LESSEE while leasing the property.
- The LESSOR does not accept any liability whatsoever for any death, accident or injury, irrespective of nature or cause, incurred to the LESSEE, or any of his guest or third parties during the leasing period. The LESSEE agrees that all members of his party are duly insured to cover all direct or indirect risks, arising from the leasing of the PROPERTY.
- The LESSEE must ensure the children under the age of 18 years are not left in the PROPERTY un-supervised during the stay.
- The LESSOR does not accept the liability for acts of violence, nature, fire, flood, war, civil disobedience, riot or other force majeure that may have a deleterious effect on the LESSEE.
By confirming a booking for the PROPERTY, any party agrees to know and strictly abide by the TERMS AND CONDITIONS stated in this Agreement.
